Our Instruction - To act on behalf of a tenant in respect of a schedule of dilapidations served on them.
The Property - Commercial premises.
The Location - Colchester, Essex.
We were instructed by our client, an outgoing tenant of a commercial premises, to respond on their behalf to a terminal schedule of dilapidations served on them by their landlord.
After undertaking a desktop study of the lease and a schedule of condition attached to the lease, we inspected the premises and noted which alleged breaches were, in our opinion, correctly stated. We were then able to respond to the landlord's surveyor, via a Scott Schedule, confirming agreed breaches. As part of our response, we also amended costings, where applicable, to each agreed breach.
Th schedule of condition attached to and forming part of the lease was invaluable in this instance, as it was sufficiently detailed, both in word and photographs, to remove many alleged breaches which otherwise would have been the responsibility of the tenant.
